Rosner, Barry & Babbitt, LLP’s Auto Fraud Legal Center recently hired two associates, Josh Anaya and Dana Turner, to work in their San Diego office. Mr. Anaya is a graduate the University of Hawaii (B.B.A., Finance, 2006) and California Western School of Law (J.D., 2009). As a law student, Mr. Anaya was awarded scholarships to attend CWSL as well as for his criminal defense advocacy at the San Diego County Office of the Public Defender. Mr. Anaya continues his passion for fighting for the underserved as a California Auto Fraud and California Lemon Law Attorney. Prior to joining Rosner, Barry & Babbitt, LLP, Mr. Anaya worked for a non-profit consumer organization dedicated to fighting utility company abuses. March 8th, 2012Sign Petition Asking Enterprise Rent-A-Car to Cease Renting Vehicle Under Safety Recalls
March 1st, 2012The Consumers for Automobile Reliability and Safety “CARS” and other advocacy groups in the rental car safety battle have linked up with Change.org, which is the largest online platform for social change in the US. There are asking concerned citizens to sign a petition that asks Enterprise Rent -A-Car to cease its practice of renting vehicles that are under a safety recall to hapless, unsuspecting rental car customers — in one particularly horrific case, two sisters, ages 24 and 20, were killed after they were led to believe they were getting an “upgrade.” Polling results show that 86% of people — even in Enterprise’s home state of MO — think this practice should be outlawed. California Supreme Court Refuses To Review Ruling Holding Claims Under the Automobile Sales Finance Act are Subject to Four Year Statute of Limitations
December 15th, 2011Rosner, Barry & Babbitt, LLP’s Auto Fraud Legal Center is pleased to announce the California Supreme Court has refused to review a trial court decision holding actions for rescission under the Automobile Sales Finance Act are subject to a four-year statute of limitations. The Supreme Court issued its order denying a petition for review filed by Santa Maria Ford and Wells Fargo Dealer Services on December 14, 2011, in Santa Maria Ford v. Superior Court (Martinez), Case Number S197395. In Martinez, Santa Maria Ford and Wells Fargo Dealer Services filed motions for summary judgment arguing Mr. Martinez’s claim under the Automobile Sales Finance Act was subject to either a one-year, or three-year, statute of limitations. In August 2011, the trial court agreed with Mr. Martinez the appropriate statute of limitations for an action for rescission of a written contract is four years pursuant to Code of Civil Procedure Section 337. …
